The flagrant lawlessness of the judiciary in curtailing, and at times abrogating, the constitutional rights of individuals and economic groups is the provocation for this book. We hope to focus attention upon the fact that liberties guaranteed by the Constituion are being gradually and deliberately extinguished by the judiciary. Most violations of the law by judges, as well as by other officials, are not recorded in juridical tomes. The amazing fact is not that so much lawlessness exists, but that so many judges brazenly exhibit their lawlessnes to public view. A high regard for the judiciary as an institution is not irreconcilable with criticism of the judges for having usurped a position and elvated themselves above other governmental departments. They have made themselves the guardians of special privilege and the executioners of the liberties of the people. Most of the cases referred to have been obtained from the official law reports. We have also made use of other sources including newspaper reports of cases which are otherwise unreported and inaccessible. Wherever possible we have verified them and in such instances have found them substantially correct. Those that we could not verify have been quoted for whatever their value may be as contemporary factual reports. We have omitted the names of judges which the reader may readily find by referring to the original source given in the annotations. 303 pp.
